Bradshaw Facts: An Ohio exertion court found Sean Carter, a schizophrenic, guilty of raping, robbing, and murdering his adoptive grandmother, and sentenced him to death, despite his plea of incompetency. On appeal, the Ohio Supreme approach upheld the trial courts declaration of Carters competence. Carter sought a habeas hearing in national govern court. They dismissed the petition and tolled the one class statute of limitations on the Antiterrorism and Effective Death Penalty Act. The U.S. Court of Appeals for the Sixth Circuit ruled that the petition could be stayed only until Carter was competent.
